Unless a particular initiative provides a separate privacy policy, this Privacy Policy applies to HAM Strategy-operated initiatives regardless of the city, community, market, publication, directory, campaign, or brand name under which an interaction occurs.

Consent to receive marketing SMS messages is not a condition of purchasing goods or services.

HAM Strategy will process applicable SMS opt-out requests in accordance with applicable law, carrier requirements, and messaging-program requirements.
An SMS opt-out may not prevent HAM Strategy from communicating through another lawful channel when appropriate, such as email, unless the individual separately opts out of that channel or applicable law provides otherwise.
Scope of SMS Consent
Consent applies to the applicable sender, program, campaign, or communication purpose for which consent was obtained. HAM Strategy does not treat consent provided for one messaging program as blanket consent for unrelated third-party companies to send marketing text messages.
HAM Strategy maintains consent and opt-out information as reasonably necessary to administer its messaging programs, document communication preferences, and comply with applicable requirements.
7. Email Communications
HAM Strategy may send both marketing and non-marketing email communications.
Marketing emails may include information concerning services, advertising opportunities, promotions, local initiatives, business-growth services, or other relevant offerings.
Where required, marketing emails include an unsubscribe mechanism. Recipients may use the unsubscribe link or other instructions provided in the communication to stop receiving applicable marketing emails.
HAM Strategy may continue to send certain non-marketing, transactional, administrative, or service-related emails when reasonably necessary to:

Such communications will be sent subject to applicable law.
8. Meta/Facebook/Instagram Lead Forms
HAM Strategy and HAM Strategy-operated initiatives may advertise through platforms operated by Meta and other social media or advertising providers, including Facebook and Instagram.
When an individual submits information through a Meta Instant Form or similar advertising-platform lead form, the information submitted may be transmitted to HAM Strategy and entered into our CRM, communications, advertising, or automation systems.
Once received by HAM Strategy, that information may be processed in accordance with this Privacy Policy.
Meta and other advertising platforms separately collect and process information according to their own terms, privacy policies, settings, and practices. HAM Strategy does not control those independent privacy practices.
Submitting a Meta, Facebook, or Instagram lead form does not automatically constitute consent to receive marketing SMS messages.
Where HAM Strategy requests consent to send marketing SMS messages through a Meta lead form or related process, the applicable consent language and affirmative opt-in mechanism will be presented separately or as part of the applicable form experience in a manner intended to satisfy applicable requirements.
The scope of any consent is governed by the language presented at the time the individual opts in.
9. CRM, Marketing Automation and Communications Platforms
HAM Strategy may use CRM, marketing automation, communications, hosting, telecommunications, and related technology platforms to operate our business.
These systems may be used to:

Not every call or interaction is necessarily recorded or transcribed.

Nothing in this section changes the stricter protections applicable to mobile information and SMS consent described below.
14. Mobile Information and SMS Consent — Non-Sharing Policy
HAM Strategy applies additional restrictions to mobile information and text-messaging consent information.
No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.
HAM Strategy may disclose mobile information to subcontractors, vendors, or service providers that assist HAM Strategy in providing support or operating its communications systems, including CRM, telecommunications, messaging, customer-service, hosting, security, and technology providers, to the extent reasonably necessary for those providers to perform services on our behalf.
Such operational disclosures do not authorize those providers to use the information for their own independent marketing or promotional purposes.
Text messaging originator opt-in data and consent information will not be shared, sold, rented, or otherwise disclosed to third parties or affiliates for their own marketing or promotional purposes.
This includes records indicating that an individual agreed to receive text messages, the scope of that consent, and related SMS opt-in information.
HAM Strategy may maintain or disclose such information when reasonably necessary to:

HAM Strategy is based in California.

Our business services, advertising programs, and marketing initiatives are not intended for children under 13 years of age.
HAM Strategy does not knowingly collect personal information from children under 13 through its business services.

Some browsers historically have offered “Do Not Track” signals.
